Israel to Appeal ICC Arrest Warrants for Netanyahu and Gallant Amid War Crimes Allegations

Israel has announced its decision to challenge the arrest warrants issued by the International Criminal Court (ICC) for Prime Minister Benjamin Netanyahu and former Defence Minister Yoav Gallant.

The warrants were issued on the suspicion that both men were involved in war crimes and crimes against humanity during Israel’s military actions in Gaza following the October 7, 2023, attack by the Palestinian militant group Hamas. In response, Israel’s government has sought to have the warrants suspended until the appeal is heard.

The ICC issued the arrest warrants last week, accusing Netanyahu and Gallant of being criminally responsible for actions taken during the ongoing conflict with Hamas.

These charges include accusations of starvation as a method of warfare, as well as crimes against humanity such as murder, persecution, and other inhumane acts. The court’s investigation into their roles is centered around the humanitarian impact of Israel’s military operations in Gaza.

The move has sparked a vehement response from Israeli officials. Prime Minister Netanyahu quickly condemned the ICC’s decision, labeling it as politically motivated and accusing the court of anti-Semitism.

In a statement, Netanyahu’s office declared, “The State of Israel challenges the jurisdiction of the International Criminal Court and the legitimacy of the arrest warrants issued.” Netanyahu went on to state that Israel would not be deterred from defending its citizens, despite the international legal challenges.

In its appeal, Israel is questioning both the jurisdiction of the ICC and the legitimacy of the arrest warrants themselves. The government argues that the court has no authority over Israeli citizens or the military actions taken in the defense of the state, especially as Israel is not a member of the Rome Statute, which governs the ICC. Israel’s appeal is also framed as a defense of the country’s sovereignty, asserting that the ICC’s actions are biased against Israel.

Should the appeal be rejected, Israel warned that this would underscore what it views as the ICC’s bias against the state of Israel and its policies. The Israeli government has been vocal in its criticism of international bodies, including the ICC, for their perceived one-sided approach to conflicts involving Israel and Palestinian militants.

Fadi El-Abdallah, a spokesperson for the ICC, stated that the court would not comment directly on Israel’s appeal. He noted that if a request for an appeal is submitted, it would be up to the ICC judges to decide whether to approve it. The court has yet to make any further statements regarding its ongoing investigation into the Israeli-Palestinian conflict.

The case also brings to light the ICC’s broader scrutiny of all parties involved in the conflict. Earlier, the court issued an arrest warrant for Hamas military chief Mohammed Deif, accusing him of war crimes as well. Israel, in turn, claimed to have killed Deif in an airstrike in Gaza in July 2024. However, Hamas has not confirmed his death, leaving questions about the truth of the claim unresolved.

The ICC’s investigation into alleged war crimes by Israeli officials and Hamas militants reflects the increasingly complicated and polarized international response to the ongoing conflict in Gaza. For Israel, the ICC warrants are not just a legal issue but a deeply political one.
