SEC Secures $8.2 Billion in Financial Remedies for Investors in 2024: A Milestone Year for Crypto Enforcement

In 2024, the U.S. Securities and Exchange Commission (SEC) made waves in the financial world, securing $8.2 billion in financial remedies despite a significant 26% drop in enforcement actions. The year saw fewer cases, but the SEC’s high-profile prosecutions and strategic focus led to unprecedented monetary judgments, particularly in the cryptocurrency sector.

A landmark victory against Terraform Labs and its founder, Do Kwon, was pivotal in the SEC’s achievements. After a jury found Terraform Labs liable for fraud, the defendants agreed to a final judgment of over $4.5 billion in penalties—the largest financial remedy ever secured by the SEC following a trial.

This case alone accounted for more than half of the year’s total monetary judgments and underscored the SEC’s commitment to combating fraud in emerging financial markets.

The agency’s enforcement efforts resulted in $6.1 billion in disgorgement and prejudgment interest and an additional $2.1 billion in civil penalties. These figures highlight the SEC’s ability to impose significant financial repercussions, even as its overall enforcement actions decreased.

The SEC pursued 583 enforcement actions in 2024, reflecting significant changes across its categories of enforcement:

  • Stand-alone actions: 431 cases, representing a 14% decline from the previous year.
  • Follow-on administrative proceedings: 93 cases, down 43%.
  • Delinquent filing actions: 59 cases, a 51% decrease.

While the total number of cases dropped, the SEC maintained a sharp focus on impactful cases, prioritizing investor protection and tackling large-scale fraud.

The cryptocurrency sector was a major focus of the SEC’s enforcement efforts in 2024. The agency pursued significant cases, including:

  • Silvergate Capital: Charged for misleading disclosures regarding compliance with the Bank Secrecy Act (BSA) and Anti-Money Laundering (AML) regulations.
  • Barnbridge DAO: Faced action for unregistered securities offerings.
  • HyperFund Pyramid Scheme: A $1.7 billion fraud case involving extensive investor losses.
  • NovaTech Scam: Impacted 200,000 investors, further highlighting the need for vigilant oversight in crypto markets.

The SEC also took its first enforcement actions against relationship investment scams, targeting NanoBit and CoinW6 platforms, marking a new chapter in its approach to digital financial fraud.

The SEC’s Division of Enforcement boasted a perfect record in federal district court trials, winning all five cases it pursued, including the landmark Terraform Labs trial. Beyond financial remedies, the agency implemented critical investor protection measures, barring 124 individuals from serving as officers or directors of public companies.

The SEC distributed $345 million to harmed investors in 2024, continuing its commitment to restoring investor confidence. Since 2021, the agency has returned over $2.7 billion to defrauded investors.

The SEC processed a record 45,130 tips, complaints, and referrals in 2024, including over 24,000 whistleblower tips. This led to $255 million in whistleblower awards, underscoring the vital role of informants in exposing financial misconduct. The volume of tips reflects increased market participant cooperation and self-reporting, according to Acting Enforcement Director Sanjay Wadhwa.

As SEC Chair Gary Gensler prepares to step down on January 20, 2025, his tenure has been a lightning rod for debate. Crypto enthusiasts and retail traders have criticized his regulatory approach, labeling it overly stringent. However, the SEC’s 2024 enforcement report paints a different picture—one of a vigilant agency tackling financial crime with tenacity.

Gensler described the Division of Enforcement as a “steadfast cop on the beat,” and its results support this assertion. Under his leadership, the SEC has not only secured record-breaking penalties but also prioritized returning funds to investors and cracking down on fraud in emerging markets like cryptocurrency.
